Applicable Law and Venue
These Terms and Conditions and your use of this site will be governed by and construed in accordance with the laws of the State of New York, applicable to agreements made and to be entirely performed within the State of New York, without resort to its conflict of law provisions. You agree that any action at law or in equity arising out of or relating to these Terms and Conditions shall be filed only in the state and federal courts located in New York City, New York and you hereby irrevocably and unconditionally consent and submit to the exclusive jurisdiction of such courts over any suit, action or proceeding arising out of your use of this site, any purchase from this site, or these Terms and Conditions.
All Shipments are Insured
Absolutely ALL of our shipments are insured for the full value of the purchase. We never make an exception as this policy is for our customer’s protection as well as our own. In the instance of a package going missing before a customer is able to sign for it, we will first make all attempts at locating the package (1-3 business days). OroLatina management will then file a claim with the shipping company and send a new item immediately to our customer or refund their money if we no longer have the item in stock. We do not keep the customer waiting for our claim to be resolved before the customer receives their merchandise. At most, our customer will be subject to up to a 5 business day delay when a package goes missing. We believe this is a reasonable amount of time for us to do our due diligence in tracking the package, investigating the package’s disappearance and Processing & Shipping a new order out to our customer at no additional cost. Special Orders & Custom Orders may experience more significant (up to 16 weeks depending on the labor intensiveness of the order) delays in such circumstances.
We expect that any returns to us also be insured for the full value of the purchase. Please see our Return Policy for more details or contact your OroLatina.com representative.
Alternate Shipping Addresses
If you specify a different shipping address from your Billing Address, we must exercise additional due diligence to verify the validity of your Shipping Address as well as verify the identity of the customer. We will not process any orders where we cannot verify the validity of the Shipping Address and/or verify the identity of the customer. A simple call to your bank or credit card provider will allow you to add your desired shipping address to your account and result in less processing time. This is a requirement and not having your shipping address on file with your bank or credit card provider will delay the processing of your order. Please be prepared to scan and/or fax a copy of your Government Issued Photo Identification and your Credit Card (both sides) to us for Identity Verification. To avoid unnecessary order processing delays, we encourage our customers to use any of our secure payment methods such as Amazon Payments, ClickandBuy, Google Checkout, Mazooma, Master Card SecureCode, PayPal (PayPal user's MUST have their shipping address confirmed with PayPal prior to placing their order. Orders with a non-confirmed address, or that are otherwise not eligible for Seller Protection may be cancelled), Verified by Visa or Bank Wire Transfer.
Comparison Purchasing Policy
OroLatina reserves the right to extend and to revoke at its discretion Comparison Purchasing privileges to repeat customers who prove to be Serious Buyers. If a non-privy customer repeatedly orders multiple items only to return the entire selection, OroLatina may charge up to a 20% restocking fee.
Jewelry Appraisal and Certifications
OroLatina offers GIA and/or Macy’s Jeweler certifications & appraisals at an additional cost of USD200.00 for jewelry under USD2500.00. We do not, by default, have every piece of jewelry we take into inventory appraised. Therefore, if you wish your purchase to ship with an appraisal certificate, you understand this will delay your shipment by up to an additional 2 weeks (2 days for a Macy’s (34th Street, NYC) Certificate and Appraisal, 2 weeks for a GIA Certificate and Appraisal).
Legal Notices
OroLatina will not be liable, under any circumstance for any indirect, incidental, consequential or other special damages of any kind, regardless of the form of action, whether in contract, tort (including but not limited to negligence), strict product liability or otherwise, even if OroLatina has been advised of the possibility of such damages. Payment Methods
OroLatina accepts several forms of payment. We accept Mastercard, Visa, American Express, Discover, PayPal, Amazon Payments, Google Checkout, ClickandBuy, & Bank Wire Transfer (where money is wire transferred from the customer’s bank account into our own bank account). Customers who use Bank Wire Transfer will receive a 2% discount on their order to help offset the wire fee. We encourage our customer's to use any one of the Secure Payment methods we offer.
Product Availability
OroLatina works hard to keep its catalog and inventory up to date. However, sometimes an item goes out of stock, becomes discontinued, and/or is placed on back-order before we are able to update the website. For this reason, OroLatina does not make any guarantees of product availability. Generally speaking, roughly 75-95% of all of our items are in stock depending on the season. We tend to have our highest in-stock rates shortly before the Christmas shopping season (September / October), early January (pre-Valentine’s Day) and in April (pre-Mother’s Day).
Back Ordered items can take from 4-12 weeks to arrive at our warehouse from the manufacturer. In some situations we are able to expedite this and encourage you to contact your OroLatina.com representative if you have any questions. If you wish to purchase a back ordered item you may contact your OroLatina.com representative to place you on a list of people to be contacted when the item comes back in stock. We strongly suggest pre-paying for back-ordered items as this will minimize the processing time of your order and will ensure that if/when an item does come back into stock, you will be ensured receipt of the product. OroLatina operates from large, wholesale only operaations where products come in and out of stock quickly.
Pricing Policy
OroLatina.com’s prices change every day, Monday through Friday and are updated daily. OroLatina retails its jewelry at a price that is very close to the wholesale price of gold, which is based on the 2nd London Fix price, an internationally accepted, and the most widely used daily spot price for gold in the world. The 2nd London Fix is the price of gold at the opening of the United States Commodity Markets. OroLatina has no control over the price of gold and makes no forecast or guarantee as to the price of gold’s direction over any time period. All sale prices are final, even if the price of gold drops the next day, next week, next month or next year. As a general rule, credits / refunds will not be issued should the price of gold drop between the Completion of Sale and Receipt of Goods by the customer, just as OroLatina will not charge more or seek to charge more if the price goes up the next day after a Completion of Sale.
OroLatina will not negotiate on price under any circumstances. We encourage our customers to make a purchase when they find something they like at a price they find attractive. For those who do wish to watch for price dips, every item on our website can be monitored. Look for the Watch This Item box on the product’s page and subscribe to one of the available feeds. Once subscribed, you will be notified daily of any changes to the price, item availability, or item description.

Privacy Policy
OroLatina does NOT share in anyway, shape or form any of our customer information be it public or private information. We solemnly promise to never change this policy. Our customer’s privacy is paramount to all other concerns, whether they have made a purchase or not. All of our customer information is encrypted in our database and all transactions are encrypted via SSL (Secure Socket Layer) technology in real time to provide our customer’s maximum protection and assurance that their financial information is safe from unauthorized viewing while they make their on-line purchase. We also utilize 3rd party independent services, as well as our own technology staff, to scan our website daily for vulnerabilities. If a weakness is found, it is immediately rectified and depending on the severity of a security loophole, we reserve the right to refuse all incoming transactions until the vulnerability is corrected. In such a situation, it would become impossible for you or any of our customers to input any information into the website until the security threat was resolved.
30 Day Return Policy
OroLatina offers a 30 Day Money Back Guarantee on all orders except Special & Custom orders.
Special Orders are orders from customers for merchandise that we either do not carry in our stock, or items that may have previously been carried as stock items but are no longer going to be re-stocked. The Customer will be notified immediately, prior to any fund(s) caputure and order fulfillment if their order status must be changed to Special Order. Customer has a right to a full refund in the case of such a change to order status by OroLatina and/or OroLatina may cancel the order and refund the customer in full at any time for any reason.
Custom Orders are defined as orders where Product(s) have been engraved, lengthened, shortened, resized or otherwise modified by either OroLatina at the customer's request; or by any third party, post sale, by either the customer(s) individually and/or collectively, or performed at the customer's or other party's request by a separate 3rd party.
If you are unhappy with your purchase and neither OroLatina, nor any other party has modified the jewelry from its original condition, you may return the product(s) within 30 days of shipping receipt for a full refund. Refunds are issued the same day the return is physically received and our expert jewelers have verified that the item is still in its original condition. Returns must be made in the manner prescribed by OroLatina (See 30 Day Returns for more details). OroLatina reserves the right to refuse product returns where the jewelry has been Damaged or is showing signs of wear.
OroLatina makes every attempt to satisfy it's customer's requirements and to exercise good faith. OroLatina reserves the right to, under special circumstances AND at it's discretion,
a) Extend its 30 Day Money Back Guarantee (ie: Christmas Season, and other special circumstances)
b) Issue partial refunds for orders returned after 30 days (except when officially extended to a specific date per bullet 'a' above.
c) Issue partial refunds for jewelry showing damage or signs of wear returned within 30 days of purchase. In such circumstances, the customer will always be given the choice of a partial refund or to receive the product(s) returned to them.
d) Issue a refund less a restocking fee for customer's who abuse our Comparison Purchasing program or engage in Comparison Purchasing without first receiving authorization from OroLatina.
e) Recind it's 30 Day Money Back Guarantee. OroLatina may cancel this guarantee at any time. Guarantees on Orders placed before the date of such a change would still be honored. OroLatina may also recind its Money Back Guarantee on specific items without notice. Any Pending Orders where this might occur would result in the customer being notified and given the option for a full refund, or to receive their order.
f) Make or otherwise derive and engage in special deals with individual customers. The terms of any such agreement will occur and be recorded via email and/or fax. OroLatina keeps all customer correspondance and a complete audit trail of user and customer service activities on and via the OroLatina.com web site. OroLatina reserves the right to refuse to extend the same or similiar deal to other customers and/or a sequential/additional time to the same customer.
Order Cancellations
Having second thoughts on your purchase? Immediately contact your OroLatina.com representative and inform them of your decision to cancel your order. In most cases we are able to cancel the order before it ships and credit our customer’s account in the same day. However, if a purchase ships before a customer is able to cancel, the customer must either:
1) Receive the item and ship it back to OroLatina per our Return Instructions.
2) Refuse the delivery.
In either case, OroLatina will refund the customer the purchase price for any products shipped that are covered by OroLatina's 30 Day Money Back Guarantee when we have physically received the merchandise back and not before.
